RecPlex ACH Bank Draft 12 Month Membership Contract
Membership Privileges: This agreement shall cover the privileges and services, as of the date of this agreement, but the RecPlex reserves the right to make such change in its programs and facilities as it, in its sole discretion, deems advisable to the effective conduct of business. RecPlex reserves the right to close or restrict access, without advance notice, any area, or the entire facility for any reason, including but not limited to, cleaning, remodeling, maintenance (whether planned or unplanned), health and safety, reservations, or events. Updates on these closures can be found on our website, and facility signage. Membership dues are not affected by closures, usage of the membership, or availability of amenities.
Joining Fee: A non-refundable joining fee is due and payable upon execution of this agreement for all new memberships. The facility fee is a one-time fee, as long as the membership is maintained through payment. If your membership is cancelled or expired and is not renewed within thirty (30) days, the joining fee will be charged to rejoin as a new member.
Right to cancel within (3) days of date of agreement: You are permitted to cancel this agreement until midnight of the third operating day after the date on which the agreement was signed. If within this time period you decide you want to cancel this contract, you may do so by notifying RecPlex by means of written correspondence to RecPlex at the address shown above, within the previously described period. If you cancel, any payment made by you, less a user fee per day of actual use, will be refunded within 30 days after notice of cancellation is delivered, and any indebtedness executed by you will be cancelled by RecPlex and arrangements will be made to relieve you of any further obligations to pay the same.
ACH/Bank Draft Agreement Term: The term of the agreement shall be a minimum of twelve (12) months and continuous beyond twelve months until a cancellation request is submitted through the online Membership Cancellation Request Form.
ACH Electronic Fund Transfer Authorization
EFT Fees: This payment plan is provided at an additional monthly charge. Please see the member services staff for the current monthly fee. Initial payment of your prorated and first month’s membership fees is required to initiate the plan.
Monthly Membership Fees: The monthly membership fee shall be due and payable each month that the agreement is in effect by electronic bank draft. The amount of such monthly fee may be changed at any time during the term of this agreement provided that no such change shall be effective until at least (30) days after written notice of such change shall have been sent to the member.
Automatic deduction from financial institution account:
I hereby authorize the RecPlex, and the financial institution designated in this agreement to begin automatic deductions from the account designated in the amount of my monthly membership dues, fees and balances due.
I understand that my monthly bank statement will typically show the amount and the date payment was made to the RecPlex. I understand that I am responsible for ensuring that the account designated above has sufficient available funds on my automatic payment date and up to 12 business days after that date, to allow for the automatic deduction of my payment. I understand if I have an outstanding balance on account my monthly membership billing amount will include the addition of the full balance due on account. I understand that should my account not have sufficient funds available on the billing date that my account may be subject to a reattempt to collect funds up to 12 days after the initial billing date. I understand that my deduction will occur on the 2nd day of each month, or up to 12 business days thereafter.
This authority is to remain in effect and regular automatic deductions shall continue until an automatic payment cancellation request is filed (cancellation request subject to approval). Notification of any changes to the account or any request to cancel the automatic bank draft payment plan must be made on or before the 19th of the month prior to your scheduled bank draft.
I understand that I will receive written notice of any change in the date of my automatic deduction or any change in the membership amount due and I understand that the RecPlex will cancel my participation in this plan if they are unable to collect any payment due. Furthermore, I understand I am liable for any uncollected payment for any fees or penalties imposed by the RecPlex or my financial institution related to any uncollected payment.
I understand at the time of termination of this agreement for any reason I must make other arrangements for payment of my membership fees.
I agree to the terms of this document, as well as the RecPlex bank draft payment schedule and its policies.
Agreement Termination/Suspension: This membership agreement can be terminated by the main member for the following reasons: moving outside a 50 mile radius of the RecPlex, medical reasons or active duty military leave. In order to terminate/suspend the membership during the first year documented proof (i.e. military leave documents) must be provided to the RecPlex. The membership will be terminated within thirty (30) days after the receipt of written notice. The membership remains active, and monthly payments or any outstanding balances are required paid, through the thirty (30) day period. If the membership termination/suspension is approved in the first year, a termination/suspension fee applies unless military. If subsequent decision is made to rejoin the RecPlex, the prevailing joining fee and membership fees apply.
Fees/Refunds: There are no retroactive refunds for any membership. Written notification and supporting documentation are required for any membership cancellation or if requesting eligibility for lower rates (i.e. switching current membership to resident rate). The rates/refund will only be processed following approval of written request. The primary member may add sub-members to their account at any time as long as they meet the requirements defined by the RecPlex. A change fee will be required for each sub-member that is deleted within one year of their addition. This fee will be applied to the same sub-member each time they are added within one year of each reinstatement date.
Membership Holds and Freezes: Pending management approval, a membership may be put on hold once per calendar year for a maximum of one month. A membership hold fee will be charged to maintain the membership and regular membership dues will automatically resume at the end of this time. If a member would like to end their membership hold early, prorated membership dues will apply in addition to membership monthly hold fee for current month. If a membership is placed on hold before the 12 month contract is completed an equal amount of time will be added to the initial 12 month commitment.
A membership can be placed on a freeze due to medical reasons for maximum of three months if supporting documentation can be provided prior to the freeze period. To extend the medical freeze additional documentation needs to be submitted prior to expiration of initial freeze. No additional fees apply to membership freezes.
Membership Suspension or Termination: RecPlex reserves the right to suspend or terminate a membership or anyone on a membership account at any time, for any reason, without notice. Failure to comply with rules, regulations, and policies as well as actions we deem to be inappropriate, rude, or disrespectful towards other members, staff, or the facility will result in membership suspension and or termination. No refunds will be due for duration of suspension or if membership is terminated.
Youth guidelines:
If youth are between the ages of 10-13, parents or guardians must remain in the facility at all times.
Youth under 10 years of age must be directly supervised at all times by a parent or guardian 18 years or older.
No children under 14 years old are allowed in the 2nd floor fitness area.
If a parent or guardian is present, youth under 14 can use the track during family track hours.
Children over the age of 3 are not allowed in the opposite gender locker room. Usage of the family changing room is required when the opposite gender parent or guardian are accompanying children over the age of 3.
Strollers or infant carriers are allowed throughout the facility except in the fitness area. Parent or guardian must be with the infant or toddler 100% of the time.
No children under 14 years old are allowed in the aqua arena or waterpark without a parent or guardian. Children under 10 years old need a parent or guardian directly in the water with them at the aqua arena.
Lost and Found policy:
The RecPlex collects lost and found items daily. Valuable items are secured and kept for one month. After one month valuable items are removed from the facility. Clothing and miscellaneous items are stored for 2 days and then removed from the facility. RecPlex is not responsible for lost items.
Locks, Locker rooms and towels policy:
All members and daily users are strongly encouraged to lock all belongings in a day use locker. Individuals need to supply their own lock, as well as their own towel. Any lock remaining on a locker at the close of the building each evening will be cut. Contents will be placed in the lost and found and lost and found policy will apply to the items. RecPlex is not responsible for any lost or stolen items.
RecPlex courtesy code:
In the spirit of positive individual and family recreation and fitness pursuits, the Village of Pleasant Prairie and the RecPlex Management are dedicated to providing high quality leisure experiences. Therefore, all RecPlex members and patrons utilizing the facilities, programs and services of the Park and Recreation Division are obligated to adhere to the following policies and expectations:
Be respectful and courteous of others at all times.
Foul language and inappropriate gestures will not be tolerated.
Physical violence against another individual will warrant police involvement and prosecution to the full extent of the law.
Theft and vandalism will be met with police involvement and prosecution to the full extent of the law.
Membership cards and daily pass wristbands are not transferrable to anyone.
Anyone suspected of being impaired will warrant police involvement.
Abide by posted general rules and regulations set forth in each recreation division.
If policies and regulations are not followed, any RecPlex user can be warned, suspended from use, or membership or daily usage terminated. Any user not abiding by the warning, suspension or termination will be seen as trespassing and will warrant police involvement.
Release agreement: I, releaser, being of lawful age do hereby acknowledge that I have been informed on RecPlex facility guidelines for proper use of the RecPlex facilities, and in consideration of being permitted to use such facilities do for myself, my heirs, administrators and assigns, hereby release and forever discharge the Village of Pleasant Prairie, all past, present, and future officers, directors, agents and employees of the foregoing and all heirs, administrators, legal representatives, and assigns of the foregoing, from any and every claim, demand, action, or right of actions, of whatever kind or nature, either in law or in equity, arising from or by reason of any bodily injury known or unknown, death or property damage resulting or to result from my use of the RecPlex facility. I further release all RecPlex personnel from any claim whatsoever on account of first aid, treatment or service rendered me as a result of my use of RecPlex facilities. I acknowledge that no promise or inducement has been offered or made except herein set forth, that this release is executed without reliance on any statement or representation by release or by any agents or physicians of release concerning the nature and extent of potential injuries and damages that may arise as a result of my use of the RecPlex facilities, and that I have carefully read the release, know the contents thereof, and sign it as my own free act. I witness whereof, releaser has executed this release at the RecPlex, Pleasant Prairie, Wisconsin, on the date above.

Participating in RecPlex programs or accessing RecPlex/Village of Pleasant Prairie facilities could increase the risk of contracting Covid-19. RecPlex in no way warrants that Covid-19 infection will not occur through participation in RecPlex programs or accessing RecPlex facilities. As a condition of my participation or my child’s participation in the RecPlex programs or facility usage, I accept any risk of infection from Covid-19. I specifically release and hold harmless the Village of Pleasant Prairie RecPlex from any losses, damages, or personal injury to myself, my child, or my household from participation in any RecPlex programming or facility activity.
Membership Terms: As a member of the RecPlex, it is agreed that I assume responsibility for the full payment of membership fees and all charges incurred by myself, my guests and persons in my household included on this contract. I understand that any persons added to my membership mid-contract are also subject to all the terms of this contract. I understand my membership does not confer any ownership or interest in the assets or liabilities of the RecPlex and that my membership may not be transferred to any other individual. I hereby apply for membership and agree to be bound by the membership terms, conditions, ordinances, rules, and regulations as established by the Village of Pleasant Prairie. I understand that my membership may be cancelled if I am in violation of these rules and regulations, and I will not be entitled to any refund of fees or dues paid to the date of cancellation. If the facility or services become permanently unavailable, I shall only be liable for membership fees proportionate up to the unavailability. If I am unable to make use of, or receive, the services contracted for under this agreement because of death or disability, I understand that I am only liable for membership fees proportionate up to the time written notification of death or disability is received by the RecPlex. This agreement is subject to the provisions of the laws of the State of Wisconsin governing fitness center contracts.
